Terms and Conditions of Booking

1. Definitions

"You" and "your" means all persons or any of them named on the booking including anyone added or substituted at a later date, and/or the person who has signed the booking form and includes all the people on whose behalf it has been signed.

In making a booking (which includes an enquiry), you agree that these terms and conditions apply. "You" means the person who has completed the booking form and each and every member of the group on whose behalf that person has booked with us.

  • You accept financial responsibility for all bookings in your name or account.
  • You must be over 18 years old and have the legal capacity to make the booking.
  • You must make sure that all your information is true and accurate at all times

2. Payment

A non-refundable deposit is payable at the time of booking, which will be a minimum of 20% unless otherwise stated, and the balance payable in accordance with the product confirmed, which will be stated at the time of booking and payable at least 6 weeks before departure date. All payments made by credit card will incur a surcharge of 2% of the transaction value.

Last Minute Bookings

Last minute bookings are possible, with the proviso that only certain activities are available and hotel accommodation may be difficult to secure. Payment in full must be made promptly and received by Escape2Marbella before your arrival.

The receipt/invoice is your final account and no further reminder regarding payment will be sent.

3. Cancellation/Changes

By You

All cancellations must be received in writing immediately. Cancellation charges are as follows percentages referring to the total price:

0-28 days before travel date - 100%

29-70 days before travel date - 50%

More than 71 days before travel date - loss of deposit

Should you cancel the event 12 weeks prior to the event a 200€ administration charge is payable. All remaining monies shall be refunded (excluding deposits).

If you only cancel part of your booking or decrease the number of people in the party then any relevant refund will only be paid once the entire booking has been recalculated and any changes in price taken into account.

Where possible we will endeavour to accommodate any reasonable request to change your booking. Where your travel arrangements depend on a certain number of people and your change involves a change to the number of people in your party the price for the entire booking will be recalculated on the basis of the new party size. Where we are not able, at our discretion, to help you in respect of your request to change your booking and you are not prepared to proceed with your travel arrangements as booked this will be treated as a cancellation and you will have to pay the cancellation charges set out above in this paragraph.

Although it is unlikely that we will need to make changes or cancellations we reserve the right to do so at any time. Most of these changes will be minor and due to circumstances beyond our control. We shall inform you of such changes as soon as possible and offer an alternative of a comparable standard, if available. We regret we cannot pay any expenses, costs or losses incurred by you as a result of any change or cancellation. Very rarely, we may be forced by "force majeure" to change or terminate any part or all of your booking either immediately before or after departure. If this situation does occur we will not make any refunds unless we obtain refunds from our suppliers, nor can we pay any compensation or meet any costs or expenses you incur as a result.

4. Force Majeure

Except where otherwise expressly stated in these booking conditions, we regret we cannot accept liability or pay compensation where the performance or prompt performance of our contractual obligations is prevented or affected by or you otherwise suffer any damage or loss as a result of "force majeure". In these booking conditions, "force majeure" means any event, which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.

5. Behaviour

When you book with us, you accept responsibility for any damage or loss caused by you or any member of your party. Full payment for any such damage or loss must be paid direct at the time to the accommodation owner or manager or other supplier. If you fail to do so, you will be responsible for meeting any claims subsequently made against us (together with your own and the other party's legal costs) as a result of your actions.

We expect our clients to have consideration for other people. If, in our reasonable opinion, or in the opinion of any other person in authority, you or any member of your party behaves in such a way as to cause or be likely to cause danger, upset or distress to any third party or damage to property, we are entitled, without your prior notice, to terminate the booking of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the accommodation or other service. We will have no further responsibility toward such person(s) including any return travel arrangements.

No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination.

6. Complaints

If you are dissatisfied with the services provided by E2M or our representatives please inform the relevant supplier immediately. If your complaint is not resolved locally, please follow this up within 7 days of your return home, no complaint will be accepted after this time and you will be deemed to have been fully satisfied with all parts of the booking made by us. Failure to notify the supplier immediately whilst on your trip may deprive us of the opportunity to rectify the complaint whilst you were away and this may affect your rights under this contract.

7. Liability

The contractual terms and conditions of the companies that provide the transportation for your travel arrangements will apply to this contract. These may contain terms which may limit or exclude liability to you for certain events.

In respect of activities arranged by us as part of your travel arrangements, we act only as booking agent. We therefore exclude all liability for any aspect of the activity arrangements and, in particular, liability for any loss, personal injury or death. Where activities are indicated as being available it is not intended that this should be taken as a recommendation to take part. We neither own nor operate these facilities and therefore cannot and do not provide assurances that they are maintained or operated with customers safety in mind. Please note that some activities may also be considered "hazardous pursuits" by insurance companies and may require a premium if you wish to be adequately covered by the policy you decide to take out.

8. Late Arrivals / Delays

It is your responsibility to arrive at all departure or pick-up points at the time specified in the itineraries supplied byEscape2Marbella.

We will not accept responsibility for the consequences of late or non-arrival as specified above and no money will be refunded if you miss any part of your weekend as a result. Where the arrival time of your flight is delayed and we have arranged airport transfers we will endeavour to hold the transfer for as long as possible but if this is not possible you will have to make your own arrangements on arrival and Escape2Marbella will not be liable for any additional costs incurred or refunds.

In exceptional circumstances a third party may see fit to stop an activity at any time if they feel continuing an activity would cause injury or harm to its staff or to any other persons at the site. An activity site or venue reserves the right to exclude persons considered to be medically unfit and persons considered to be under the influence of alcohol. In the cases outlined in this paragraph you will not be entitled to any refund whatsoever.

9. Passports, Visas, Health Requirements, Driving Licenses

You are responsible for the provision of necessary valid documents required for your trip.

For any break outside the UK, you will need to travel with a passport. British passport holders need a valid passport for any destination within the EU.

Non-British passport holders should check requirements themselves direct with the appropriate embassy/consulate.

It is your responsibility to ensure that you are in possession of the correct travel documents. The company will not take responsibility for any problems (denied boarding or entry, financial penalties etc) as a result of you not having the correct documentation.

We recommend that you refer your Foreign Office for up-to-date advice and information on safety and health for your destination. There are currently no special health requirements for travel to Europe.

10. Insurance

Escape2Marbella take no responsibility for your group’s travel insurance requirements. If you decide not to take out travel insurance suitable for your activities independently, you hereby agree to indemnify us against any claim of loss or injury, and you and your group members participate entirely at your own risk.

Certain activity providers may insist you sign an insurance indemnity and waiver form; therefore you participate at your own risk, and we shall not be liable for your participation.

We strongly advise all customers to have adequate travel insurance in place as soon as a booking is confirmed, including adequate cover for any activities included in your weekend. This is your responsibility

You / your confirm that I abide by the aforementioned and agree to the terms and conditions there in contained. I record that I am joining activities at my own risk and waive any claims that I might have with regard to injury, loss or death which might occur due to any causes whatsoever. I further bind my dependents, heirs, executors, administrators and assigns to the terms and conditions of this agreement, and indemnify and hold blameless Escape2Marbella, its members, associates, employees, representatives, organisers, helpers and agents from all liability for any or all claims whatsoever and howsoever arising and without limitation (including consequential claims) arising from any delay, loss or damage to property or injury or illness or death .

11 Changes to these Terms and Conditions

We may need to make changes to these Terms and Conditions. Any changes can only be made by us and not any third party member. We reserve the right to amend or improve these Terms and Conditions without prior notification. When it is necessary for changes to be made, we will forward you a copy of these changes and all reservations will abide by the amended terms, with the exception of reservations already made.
